Bankruptcy is a legal instrument granted by the court that is used when someone owes you money and it has been impossible to recover the money owed in all other ways. If the bankruptcy is granted, it allows for that person’s (the debtor) assets to be taken and sold to pay the outstanding debts. You can petition for Bankruptcy against people or corporations.
Filing the necessary documents to bankrupt someone can be a complicated process. Most people use a Bankruptcy lawyer to help them.
If you feel that the issue can be negotiated, you can also recur to third-party mediation. In this case, an impartial person helps the involved parties work out an agreement. However, if the only option left is bankruptcy you will need to:
- Prove that you are owed the money: You must provide evidence to the court via a statutory demand to the debtor (notice of request for payment) and a certificate of serving, or by getting a sheriff’s or bailiff’s statement that shows that you possess a court judgment for the money and that the sheriff or bailiff were unable to recover enough assets to pay the debt.
- Check for other Bankruptcy petitions placed in the court against the person who owes you: you can do this by ‘searching’ or checking for any bankruptcy petitions against the debtor in the past 18 months. One way to do this is by checking by county at your local court house. You should also make a declaration that you have done this check, sign it and include it with your bankruptcy petition. If you find that there is already a bankruptcy petition in place will need to use it to support your claim. Usually, this is an easier process than starting a new bankruptcy petition on your own. If there is already a bankruptcy petition in place, you can’t start a new one.
- Fill out the forms and deliver them to the court: the documents that you will need to fill out to petition for the bankruptcy will depend on whether or not the debtor has answered to the statutory request, and whether or not the sheriff or bailiff were able to recover assets from the debtor to pay the debt. In addition, you will also need to submit a declaration of the details of the petition, a declaration that you have carried out searches for other Bankruptcy petitions and evidence that you are owed the money detailed in the details of the bankruptcy petition.
- Pay the corresponding filing and court fees.
- Serve the Bankruptcy petition to the debtor: once you have all the documentation in place, you will need to ‘serve’ the debtor with a copy of the Bankruptcy petition filed with the court. Once the debtor has been served you will have a certificate of service. If you can’t serve the Bankruptcy petition to the debtor via the ways provided by the court, you can request the court to allow for an ‘alternative’ way of service which can include a notice in a local newspaper.
